Protecting customer money when brokers fail
Sponsored by Shri Thanedar
What the bill does
This bill changes how customer money and assets are handled when a commodity broker goes bankrupt. It allows the broker's own cash, securities, and other property to be used to pay back customers if the customers' own property is not enough. This only applies after certain debts to other creditors are paid.
The stakes
Farmers and investors who trade commodities could get more of their money back if their broker fails. The bill decides who gets paid first when a broker goes under.
What each side says
- It could reduce the money available to other creditors, such as banks or clearinghouses, who may have lent money to the broker.bill
